2. Purpose and scope of application
This Legal Notice governs access to, browsing of, and use of the website https://www.formenterafaster.com/, as well as the liabilities arising from the use of its content and functionalities.
Browsing the website is subject to this Legal Notice. Booking tickets or services through the platform requires the express acceptance of the General Terms and Conditions and, where applicable, the particular conditions of the relevant shipping company or supplier before completing payment.
The user may access, retain and reproduce the applicable conditions before booking.
3. Conditions of use
The user undertakes to use the website in accordance with the law, good faith, public order, this Legal Notice and the other applicable conditions.
In particular, the user shall refrain from: (i) carrying out unlawful or fraudulent activities or activities harmful to the rights of third parties; (ii) introducing viruses, malware or any system capable of damaging, interfering with or altering the platform; (iii) attempting to access restricted areas, systems or data; and (iv) using the website for purposes contrary to its natural purpose of information, booking and contracting.
4. Nature of service
Discover Pitiusas, S.L. acts as a technology platform, independent intermediary and reservation centre under Law 8/2012 of 19 July on tourism of the Balearic Islands, in the marketing of individual bookings of maritime transport services provided by shipping companies.
To this end, Discover’s activity as a reservation centre consists mainly of booking tourism services on an individual basis. Discover does not organise package travel nor does it take on the status of a travel agency through the mere intermediation in individual bookings of maritime transport.
Discover Pitiusas, S.L. is neither the owner nor the operator of the vessels or ferries offered, unless expressly indicated otherwise for a specific service.
The actual provision of transport is the responsibility of the shipping company identified during the booking process and on the ticket, booking reference or travel documentation.
Discover Pitiusas, S.L. shall be liable for the obligations legally attributable to its own intermediation services, including the information published by the platform, the processing of the booking, payment management, the issuance or transmission of the ticket or booking reference, and the customer service it undertakes.
The shipping company shall be liable for the actual provision of transport, schedules, boarding, safety, accessibility, luggage, operational incidents and other obligations proper to the carrier, without prejudice to the mandatory rights of passengers and consumers.
5. Intellectual and industrial property
All website content, including texts, designs, logos, trademarks, trade names, software, code, databases, navigation structure and interface, is owned by Discover Pitiusas, S.L. or by third parties who have authorised its use.
The reproduction, distribution, public communication, transformation, extraction, re-use or any other exploitation of such content without the prior and express authorisation of the rights holder is prohibited, except in legally permitted cases.
6. Third-party links
The website may include links to third-party pages, including pages of shipping companies, payment gateways, public bodies or other suppliers. Discover Pitiusas, S.L. does not generally control such sites and is not responsible for their content, privacy policies, availability or operation, except in legally required cases or where it has actual knowledge of an unlawful act and fails to act with due diligence.
7. Exclusion and limitation of liability
Discover Pitiusas, S.L. shall not be liable for damages arising from the improper use of the website by the user, from technical incidents attributable to third parties outside its reasonable sphere of control, from interruptions caused by maintenance, force majeure or non-attributable causes, nor from information provided directly by shipping companies or third parties where it is identified as such and Discover has not been involved in its preparation.
The foregoing limitation does not exclude or limit the liability legally incumbent on Discover Pitiusas, S.L. for its own acts or omissions, for electronic contracting carried out through the platform, for the required pre-contractual information, for the processing of personal data, for commercial communications, for cookies or for any other mandatory duty towards consumers and users.
8. Security
Discover Pitiusas, S.L. applies reasonable technical and organisational measures to protect the platform and the information processed. However, the user acknowledges that the internet is not a fully secure environment and that the absolute absence of technological risks cannot be guaranteed.
9. Governing law and jurisdiction
This Legal Notice is governed by Spanish law, without prejudice to European Union legislation and any applicable regional or sectoral regulations.
Where the user is a consumer or user, any dispute shall be submitted to the courts and tribunals that are competent in accordance with consumer and user regulations, in particular those of the consumer’s domicile where applicable.
Where the user acts for business or professional purposes and no mandatory jurisdiction applies, the parties may submit to the courts and tribunals of Eivissa, waiving any other jurisdiction that may correspond to them.
